Terms of Service

1. Acceptance of Terms

By accessing or using the Magnificent Worlds website (magnificentworlds.io) and application (collectively, the "Service"), operated by Shape d.o.o., a company registered in the Republic of Slovenia, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

If you are using the Service on behalf of a child, you represent that you are the child's parent or legal guardian and that you consent to these Terms on the child's behalf.

2. Description of Service

Magnificent Worlds is a personalised children's storybook platform. The Service allows you to: create a child profile with a name, age, and optional photo; generate personalised illustrated stories featuring your child; view, edit, and share digital storybooks; and order printed hardcover versions of your storybooks.

3. Accounts

To use the Service, you must create an account by providing a valid email address and password, or by authenticating via Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By creating an account, you represent and warrant that you meet this age requirement.

4. User Content

You retain ownership of all content you provide to the Service, including photographs, names, story prompts, and any text edits you make ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, worldwide licence to use, process, and store your User Content solely for the purpose of providing the Service to you.

Stories, illustrations, and other materials generated by the Service ("Generated Content") are created for your personal, non-commercial use. You receive a perpetual, non-exclusive licence to use, print, and share Generated Content for personal purposes (e.g., reading, gifting).

You agree not to upload or submit any content that: you do not have the right to share (e.g., photos of children who are not yours); is unlawful, harmful, threatening, abusive, or otherwise objectionable; infringes on any third party's intellectual property or privacy rights; or contains malware, viruses, or any harmful code.

5. Children's Photos

By uploading a photo of a child, you represent and warrant that: you are the child's parent or legal guardian; you consent to the photo being used for generating personalised illustrations; and you understand the photo will be processed by third-party services (as described in our Privacy Policy) solely for illustration generation.

Photos are never used for any purpose other than generating your child's storybook illustrations. You may delete the photo and all associated data at any time from your account.

6. Digital Stories (Free Tier)

Creating digital storybooks is free of charge. Free digital stories include: a complete generated story with up to 24 illustrated pages; the ability to view the story online at any time; and the ability to edit text and regenerate illustrations (subject to fair usage limits).

We reserve the right to impose reasonable usage limits on free accounts to prevent abuse (e.g., limiting the number of stories generated per day or per account).

7. Printed Books (Paid Orders)

Printed hardcover books are available for purchase at the price displayed at the time of order (currently €50 per book, plus applicable shipping). All prices include VAT where applicable.

Payments are processed securely by Stripe. We do not store your credit card details.

Books are printed on demand and shipped within 30 business days of order confirmation. Delivery times vary by destination. We ship worldwide.

Under EU consumer protection law, you have the right to withdraw from a purchase within 14 days of receiving the goods, without giving any reason. However, because each book is custom-made and personalised to your specifications, the right of withdrawal does not apply to printed book orders, in accordance with Article 16(c) of the EU Consumer Rights Directive (2011/83/EU), which exempts goods made to the consumer's specifications or clearly personalised.

If you receive a damaged or defective book, please contact us within 14 days of delivery at support@magnificentworlds.io and we will send a replacement at no additional cost.

8. Intellectual Property

The Service, including its design, logo, software, and all non-user-generated content, is owned by Magnificent Worlds and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

9. Prohibited Uses

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorised access to the Service or its systems; use automated tools (bots, scrapers) to access the Service without permission; resell, redistribute, or commercially exploit Generated Content; upload photos of children for whom you do not have parental authority; or interfere with or disrupt the Service's infrastructure.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that: the Service will be uninterrupted, secure, or error-free; generated stories or illustrations will meet your specific expectations; or the Service will be available at all times.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Magnificent Worlds and Shape d.o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

12. Account Termination

You may delete your account at any time. Upon deletion, all your personal data, child profiles, photos, and stories will be permanently removed within 30 days, except where retention is required by law (e.g., order records for tax purposes).

We reserve the right to suspend or terminate accounts that violate these Terms, with notice where practicable.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Slovenia.

If you are an EU consumer, you retain any mandatory consumer protection rights granted by the laws of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
